These Terms of Service ("Terms") form a legally binding agreement between you ("Client") and ARC11 ("we", "us", "our"). By requesting a quote, booking services, or engaging ARC11 to perform works, you agree to these Terms.
ARC11 provides specialised remote-controlled vegetation management and associated services, including but not limited to:
- Remote-controlled slope mowing
- Forestry mulching
- High-risk terrain vegetation control
- Roadside and infrastructure corridor clearing
- Drainage, culvert, and embankment maintenance
- Low-impact vegetation works in sensitive environments
- All quotes are based on information provided at time of assessment
- Final pricing may vary if actual site conditions differ from those disclosed or reasonably observable during assessment
- Quotes are valid for 30 days unless otherwise stated
- Mobilisation, traffic management, and specialist compliance documentation may be charged separately
- Minimum job charges may apply
- Payment terms are as specified on the issued invoice — typically 7–14 days unless otherwise agreed in writing
- ARC11 may require a deposit prior to commencement to secure scheduling, mobilisation, and equipment allocation
- For works exceeding $15,000, ARC11 may issue progress invoices during the course of works based on completed stages or percentage of works performed
- ARC11 reserves the right to suspend or reschedule works if required payments are not received by the due date
- Payment is due within the timeframe stated on the invoice following completion of works
- Late payments may incur reasonable recovery costs and interest in accordance with applicable Western Australian legislation
— 30% deposit to secure dates & mobilisation
— 40% progress claim mid-job (or at an agreed milestone)
— 30% on completion (7 days)
By engaging ARC11, you confirm that:
- You are the legal property owner or have authority to approve works
- You will provide safe and lawful site access
- You will disclose known hazards including underground services, irrigation, electrical, drainage, or other infrastructure
- You will obtain any required permits or approvals prior to works commencing
ARC11 is not liable for damage resulting from undisclosed or incorrectly identified utilities, assets, or hazards.
ARC11 uses specialised tracked and remote-controlled equipment intended to reduce operator exposure and minimise ground disturbance. However, vegetation management and mechanical operations inherently interact with the ground surface, and disturbance cannot always be avoided.
The Client acknowledges that:
- Track marks, scuffing, rutting, soil displacement, compaction or other surface disturbance may occur during normal operations
- Ground disturbance may be more noticeable on steep slopes, wet or saturated ground, clay soils, soft ground, recently disturbed soil, erosion-prone areas or where soil depth over rock is limited
- Exposed rock, tree roots, hidden obstacles and variations in soil or ground conditions may affect the finished surface
- Turning, traversing slopes and manoeuvring machinery may cause greater disturbance in some areas than straight-line travel
- Vegetation removal may expose previously concealed soil, rock, erosion, drainage issues, depressions or other existing ground conditions
- Weather and moisture conditions can materially affect traction, soil disturbance and the final surface condition
- ARC11 may alter the method of work, restrict access to particular areas, postpone works or cease operations where conditions present an unacceptable safety, environmental or equipment risk
Reasonable care will be taken to minimise unnecessary disturbance; however, normal ground disturbance resulting from the agreed works and prevailing site conditions is not considered damage or defective workmanship unless otherwise agreed in writing before works commence.
- Works may be delayed due to weather, ground conditions, fire restrictions, or safety considerations
- ARC11 prioritises safe operating conditions over schedule commitments
- ARC11's total liability is limited to the total contract value of the works performed
- ARC11 is not liable for indirect, consequential, or incidental damages
- Risk control advice is based on observed site conditions at time of assessment
- Cancellations must be submitted in writing
- Deposits may be forfeited if cancellation occurs within an agreed notice period
- Rescheduling may be subject to availability and site conditions
These Terms are governed by the laws of Western Australia. Any disputes shall be resolved within Western Australia.
ARC11 may update these Terms at any time. Continued engagement of services constitutes acceptance of the current version.
